Kentucky Online Gambling Lawsuit

8 - Some of the best attorneys from all over the United States
crammed into a Franklin County courtroom to ask the local
circuit judge to dismiss Kentucky's ridiculous attempt to block
its citizens access to various online gambling websites
(141), many of which are based offshore.
Kentucky Governor Steve Beshear's administration - which
supports the legalization of online casino gambling in the state
- contends that the online gambling websites are illegal
and as such Kentuckians should not have access to them.
(Incidentally Kentucky has legalized horse racing, bingo, and a
state lottery).
In answer, however, opposition attorneys have responded that the
state does not have the jurisdiction to rule on a case that may
have major international ramifications, being that many of the
online gambling websites are based outside the United States.
Lawyers representing the state asked Judge Thomas Wingate to
forfeit control of the domain names to Kentucky as they claim
the domains should be treated as 'illegal online gambling
devices' and barred from conducting ecommerce in the state.
However, Washington attorney representing the Interactive Gaming
Council Jerry Stouck responded by saying, 'These 141 domain
names do not exist here in Kentucky and therefore cannot be
seized here.'
